In a controversial new\u00a0landmark ruling that has enraged and frustrated Israeli leaders, Europe’s top court has ordered that\u00a0all goods produced by Israeli settlements in the West Bank, East Jerusalem and the Golan Heights be labeled as such<\/strong>.<\/p>\n\n

Specifically the European Court of Justice decision on Tuesday\u00a0forbids any products from settlements to be labeled simply as “made in Israel”<\/strong>; instead, they must have a\u00a0\u201cclear and non-misleading indication of origin\u201d in line with the EU’s consumer policy, as stated by an EU official communicating the ruling to Tel Aviv.<\/p>\n\n

Activists who have for years campaigned against illegal\u00a0Israeli settlement expansion into the West Bank have hailed it as a victory, and as\u00a0taking the European public\u00a0a step closer to recognizing Israel as an ‘apartheid state’<\/strong>\u00a0akin to\u00a0South Africa’s recent history.\u00a0West Bank settlement file image.<\/em><\/p>\n\n

The EU’s highest court said in a\u00a0press release<\/a>:<\/p>\n\n

\n

\u201cFoodstuffs originating in the territories occupied by the State of Israel must bear the indication of their territory of origin, accompanied, where those foodstuffs come from an Israeli settlement within that territory, by the indication of that provenance.\u201d<\/p>\n<\/blockquote>\n\n

The court ruled further that\u00a0“Israel is present in the territories concerned as an occupying power and not as a sovereign entity.”<\/strong><\/p>\n\n

The ruling follows prior 2015 guidelines mandated by the EU for member states to require especially labeling goods from settlements, but which not all followed. This also led to lawsuits where it was enacted, such as in France, brought by Israeli businessmen who sought to get the policy thrown out.<\/p>\n\n

A spokeswoman at the EU embassy in Tel Aviv\u00a0said, \u201cThe EU has a longstanding and well-known position that it will not recognize any changes to pre-1967 Israeli borders other than those agreed by the parties to the Israeli-Palestinian conflict.\u201d \u00a0<\/p>\n\n

But she also emphasized this\u00a0wasn’t an attempt at endorsing\u00a0\u201cany form of boycott or sanctions against Israel\u201d<\/strong>\u00a0\u2014\u00a0<\/em>in reference to the Boycott, Divestment, Sanctions (BDS) movement.<\/p>\n\n

Israeli leaders have sought to fiercely push back, given it will have a big impact on Israeli trade with the EU, and\u00a0could also negatively affect US trade with Europe<\/strong>.\u00a0Israeli winemaker\u00a0Psagot, based in the West Bank, will have to carry a special label in EU countries. They’ve urged the White House and Congress to pressure the EU not to implement the label ruling, with\u00a0Israeli Prime Minister Benjamin Netanyahu personally urging Secretary of State Mike Pompeo and Treasury Secretary Steve Mnuchin to put the issue front and center.\u00a0<\/p>\n\n

Several US Senators have also reportedly gotten involved, according to\u00a0Axios<\/em>, sending letters to the EU’s ambassador in Washington and\u00a0US\u00a0trade representative Robert Lighthizer,\u00a0pressuring them to ignore the ruling<\/strong>.<\/p>\n\n
